Please read this information. By purchasing and/or using images from Rachel Veser's Stockphotography you automatically agree to all statements in this section.

All images, thumbnails, slides, art photos, are the property of Rachel Veser's Stockphotography. All images and information on this site is the property of Rachel Veser's Stockphotography. b. By purchasing and/or using images from Rachel Veser's Stockphotography you agree to all statements in this License and Copyright Information Section. c. You are purchasing a license to use the images on Rachel Veser's Stockphotography. You are not purchasing the images. Copyrights and all other rights, without limitation, are retained by Rachel Veser's Stockphotography. 2. License a. This license agreement governs your use of Rachel Veser's Stockphotography Images. Rachel Veser's Stockphotography licenses to you the use of the image (s) only as provided by the international copyright law, on a non-exclusive and non-transferable basis. b. Permitted Uses 1. You may back up, copy, or archive the images as necessary for internal use. Any copy you make must include the copyright information. 2. You may resize the image for your use so long as the copyright information is not removed or obscured. Rights to any derivative work shall belong to Rachel Veser's Stockphotography. All copyrights with respect to such derivative work are assigned to Rachel Veser's Stockphotography. c. Prohibited Uses 1. Transfer rights to the image (s). All rights are reserved by Rachel Veser's Stockphotography. 2. Reverse engineer, decompile, or disassemble any part of the image (s). 3. Remove any copyright or trademark from any place where it appears on the image (s). 4. Use the image (s) in any way that could be considered defamatory, libellous, pornographic, obscene, immoral, or fraudulent. 5. Use the image (s) as part of a trademark, service mark, or logo. Rachel Veser's Stockphotography retains full rights to the image and therefore you cannot establish your own rights over it. 6. Re-sell, distribute, or sub-license the image (s)
3. Payment Terms No rights are granted until the invoice is paid in full.
Price Guide for Stock Photography Unresized digital images are available in the format 2816x2120 mega-pixels while non-digital photos and slides will have 72 dpi resolution unless 300 dpi resolution is specifically requested.

An invoice will arrive from paypal to the email address that you provide.After paypal confirms your payment to Rachel Veser's Stockphotography your images will be emailed to you at the email that you provide. You will recieve your images 1 business day after I have received your payment.
Images will arrive as a jpeg file attachment in your email unless
bmp, tiff or other formats are specifically requested. Furthermore,
non-digital photos and slides of resolution 300 dpi will be
sent on cd and not via internet, therefore longer waiting times
are to be expected.
4. Terms and Photo Credit This license is effective until it is terminated. You can terminate this license at any time by destroying the image (s), along with all copies and archives of the same, and ceasing use of the image (s) for any purpose. This license also terminates if, at any time, the licensee fails to comply with the terms of the agreement. In the event of termination of the license for non-compliance, the licensee must agree to destroy all copies and archives of the image (s), to cease using the image (s) for any purpose, and to confirm to Rachel Veser's Stockphotography in writing that you have complied with these requirements. 5. Warranty/As is The image (s) sold on Rachel Veser's Stockphotography are sold "AS IS" without warranty of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular use. Rachel Veser's Stockphotography does not warrant that the image (s) will meet your requirements or that it (they) will be uninterrupted or error free. The entire risk as to the quality and performance of the image (s) is with you. Should the image (s) prove defective you assume the entire cost of all necessary servicing, repair, or correction. Rachel Veser's Stockphotography Fine Art Photo Prints have their own warranty/return policy. 6. Limitation of Remedies Rachel Veser's Stockphotography's entire liability and your exclusive remedy, with respect to any claims arising from the licensee`s use of the image (s) or out of their actions in downloading the image (s), shall be as follows: a. Downloaded Image (s), if you are unable to download an image contact www.megagi.com within five days of the receipt of invoice. Provide a copy of the invoice and a valid email address. You may be permitted to download the image again at a location that Rachel Veser's Stockphotography will provide to you. b. No Money Damages: under no circumstances will Rachel Veser's Stockphotography be liable for any damages, including any lost profits, lost savings, or other incidental or consequential damages arising out of the use or inability to use the image (s). 7. Indemnity The licensee agrees to indemnify and hold Rachel Veser's Stockphotography free from damages from any claims or liability asserted against Rachel Veser's Stockphotography arising out of or in connection with any breach of the terms of this Agreement. 8. General a. Enforceability: if any provision of this Agreement is held to be not enforceable, such provision shall be reformed only to the extent to make it enforceable. b. Taxes: The licensee agrees to pay and be responsible for any and all sales taxes, value added taxes, duties imposed by any jurisdictions as a result of license granted, or of use of the image (s), pursuant to this Agreement. c. Discontinuance: Rachel Veser's Stockphotography reserves the right to elect at any time to replace the image (s) with an alternative for any reason. Upon notice of such replacement, the license for the replaced image (s) terminates for any products that do not already exist, and this license automatically applies to the replacement image (s). The licensee agrees not to use the replaced image (s) for future products but may continue use of the replaced image in existing products until the end of the user license. 9. Arbitration A material part of this contract is the agreement to arbitrate. Any and all disputes arising out of, under, or in connection with this Agreement, with the exception of copyright claims, shall be subject to arbitration in the country of residence of Rachel Veser's Stockphotography. 10. Legal fees If Rachel Veser's Stockphotography is obligated to go to court, rather than arbitration, to enforce any of its rights, or to collect fees, the licensee agrees to reimburse Rachel Veser's Stockphotography for all of its legal fees, costs, and disbursements if judgement is in favour of Rachel Veser's Stockphotography. 11. Entire Contract The licensee acknowledges having read this agreement, understood it, and agreed to be bound by its terms and conditions. The licensee further agrees that the same is the complete and exclusive statement of the agreement between the licensee and Rachel Veser's Stockphotography, which supercedes any proposal or prior agreement, oral or written, and any other communication between the licensee and Rachel Veser's Stockphotography relating to the subject of this agreement. |
